aCouplesPlace.com is a website owned and operated by A Couples Place Inc. (ACP).

Use of aCouplesPlace.com and its related websites aCouplesWorkshop.com, TrainingForCouplesTherapy.com, and GottmanProfessionalTraining.com (“ACP”, “TCT”, “GPT” "us", "we", “our”, “Site” or “Sites") constitutes acceptance of these Terms and Conditions of Use and our Privacy Policy.

These Terms and Conditions of Use apply to your access to, and use of, the Sites and/or Services - Please read them carefully.

The Terms and Conditions of Use do not alter in any way the terms or conditions of any other agreement you may have with A Couples Place Inc. or the Site for services, products or otherwise.

To use the Sites and/or Services, you must be 18 years old as a Legally aged Adult to enter into a binding contract and not be prohibited from using the Sites and/or Services by the laws of the jurisdiction from which you access the Sites and/or Services.

Acceptable Use

aCouplesPlace.com is a marketing and information service, and is intended to provide users with information on the services of A Couples Place, and with general information. Reliance on any information provided by us, our employees, others appearing on Site at our invitation or other visitors to the Site is solely at your own risk.

We classify Users into general two categories: “Registrants”, who sign up for therapy, email newsletters and other marketing related materials, classes, workshops, and professional trainings; and “Viewers” who use the Site seeking information about ACP and related psychological issues.

Registrants and viewers may, at their option, choose to purchase additional services from ACP, and/or its related companies and affiliates.

No Professional Advice

Any or all information, materials, content and/or advice on the Sites is for informational purposes only and is not intended to replace or substitute for any professional, financial, medical, legal or other advice. ACP expressly disclaims, and you expressly release Us from, any and all liability concerning any treatment, action by, or effect on any person following the information offered or provided within or through the Sites and/or Services. You should consult with an appropriately trained specialist for all concerns that require medical, legal, financial or other professional advice.

Privacy and Consent to Communications

Your privacy is important to us, and we provide a Privacy Policy that sets out how we collect and use any personal information collected from the Sites. Please review our Privacy Policy to which you should refer to fully understand how we collect and use personal information; your use of the Sites and/or Services will constitute your acceptance of the terms and conditions of the Privacy Policy.

By filling out any forms on the Sites or providing information to us, Registrants expressly consent to being contacted by Us and our related companies and affiliates and third-parties, whether by phone, mobile phone, email, mail or otherwise. If you are a customer or potential customer of the Site, you authorize us to provide the information that you provided us and related information we may receive from third parties for the purpose of providing Services. Such authorization shall continue in effect until you have withdrawn your consent by requesting that we no longer provide you Services; provided that we may continue to refer to and/or disclose your information when communicating as necessary for our normal business practices (such as billing matters) until such matters are closed.

Use of our Site

You are granted a limited, non-sublicensable license to access and use the Sites and all content, data, information and materials included in the Sites (the "Site Materials") solely for your personal use, subject to the terms and conditions set forth in the Terms and Conditions of Use. You will not use the Sites or any of the Site Materials other than for their intended purpose or in any way that is unlawful or harms ACP. Any use of the Sites or the Site Materials other than as specifically authorized herein is strictly prohibited and, without limiting other available remedies, will automatically and immediately terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in the Terms and Conditions of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable by ACP at any time.

The Information (as defined in the “Your Restrictions” Section below) on this Site is provided to you as a resource to consider in making health care choices, and is not intended to be the only or primary means for your evaluation of the quality of health care providers. It is not intended in any way to be a substitute for professional medical advice, diagnosis or treatment, nor is it intended to be relied upon as advice, or a recommendation, or an endorsement about which health care providers to use. ACP does not guarantee that data and/or content is complete, up to date, or accurate. You should confirm the completeness and accuracy of the data with any provider that you choose. Any conclusions contained in the Information are in the nature of opinions based upon historical data or practices but should not be considered as any representation or warranty that such data or practices are accurate or will continue to be so in the future. The Information has not been verified by ACP and you are solely responsible for any and all decisions or actions with respect to your medical treatment or choice in health care providers. Neither ACP, nor its related companies, nor its affiliates, nor its suppliers are responsible for the quality of the medical treatment or health care that you receive, except for such care as you may choose to receive from the A Couples Place Inc.

SimplePractice

ACP uses SimplePractice (SP) for Electronic Medical Records (EHR) and is our online therapy platform. Upon joining the ACP practice for therapy, registrants will be directed to SP to create a login and sign appropriate forms. In addition to acceptance of ACP’s own “Terms and Conditions of Use” and “Privacy Policy”, clients upon joining the ACP practice will be bound by SimplePractice’s Terms of Service (https://www.simplepractice.com/c/terms/) and their Privacy Policy (https://www.simplepractice.com/c/privacy/). All teletherapy and online data collected through SimplePractice is HIPAA compliant and secure.

Your Restrictions

All of the information on this Site, including, without limitation, the data, information, logos, designs, and text ("Information") are solely owned by ACP, its licensors, health care providers, or other third parties, and are protected by copyright, patent, trademark, or trade secret laws. You may use the Information for your personal use only and not for commercial purposes. You may print, download, and store Information, but you may not distribute, republish, sell, exploit, duplicate, modify, or create derivative works of the Information without the prior written approval of A Couples Place Inc. To request approval, email Lisa Lund at lisa@acouplesplace.com.

Exceptions to these restrictions will exist for those materials on the Site clearly marked as being under a Creative Commons license, in which case the restrictions for that license will apply. Under a Creative Commons license you may copy and distribute such materials with attribution to ACP but may not sell, exploit, modify, or create derivate works of the materials.

Account Security

On certain portions of the Sites, you may be provided with a password and user identification to use the Sites. You must agree to abide by these Site Terms and Conditions of Use and are responsible for all activity under such user identification. You are responsible for maintaining the confidentiality and security of any password connected with your account.

Third Party Products and Services

We may run advertisements and promotions from third parties on the Sites or may otherwise provide information about or links or referrals to third-party products or services on the Sites ("Third Party Products and Services").

We do not make any guarantees about the accuracy, currency, suitability, or quality of the information about such Third Party Products and Services, and we assume no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content made available by Third Party Products and Services. Because we do not control such Third Party Products and Services, we are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or promotions or from any Third Party Products and Services, and you use such Third Party Products and Services at your own risk.

Your business dealings or correspondence with, or participation in promotions of, such Third Party Products and Services, and any terms, conditions, warranties or representations associated with such dealings or promotions are solely between you and such third party.

You should investigate and use your independent judgment regarding the merits, quality and reputation of any Third Party Products and Services that you find on or through the Sites.

Public Areas and Submissions

If you use a "Public Area", such as a message board or forum, or other community area that allows user posts, additional terms and conditions apply to you.

You agree that any materials placed or posted by you on public areas of the Site, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information regarding ACP, the Sites, and/or the Services, provided by you in any manner ("Submissions"), are non-confidential. We are entitled to the unrestricted use, dissemination, distribution, display, reproduction, sublicense, post, and/or publication of the Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you, and we will own the exclusive rights, including all intellectual property rights, to the Submissions.

If you are an author of a Submission, you warrant that you will not post any materials that would (a) constitute or encourage conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law, including any threatening, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent messages of any kind; (b) violate or infringe upon the rights of others, including their privacy or publicity rights, or which is protected by copyright, trademark or other proprietary rights, without first obtaining permission from the person who owns or holds that right; (c) contain a virus or other material of a destructive nature; and (d) violate any law, statute, ordinance or regulation including but not limited to misrepresentation, fraud, deception, anti-discrimination, and/or false advertising.

Additional terms and conditions may apply to you in your use of the "Public Area", the message board or forum, or other community area.

Changes to our Sites and/or our Services

From time to time, and in its sole discretion,ACP may update or change the Information on this Site, but is under no obligation to do so. In addition, We may, in our sole discretion, change any of the Terms and Conditions of Use, with such change becoming effective immediately upon its posting on this Site.

  • If you maintain your own website, you may link to this Site, provided that you adhere to the following rules:
    The hyperlink must be a text-only link clearly marked "www.aCouplesPlace.com".
  • The appearance, position, and other aspects of the hyperlink may not be such as to damage or dilute the goodwill associated with ACP’s good name and trademarks.
  • The appearance, position, and other aspects of the hyperlink may not create the false impression that an entity is associated with, sponsored by, or endorsed by our Site or A Couples Place Inc.
  • The hyperlink, when activated by a user, must display the Site full-screen and not within a "frame" on the linking website and linking may not trigger any interstitial or pop-up or pop-under windows.
  • The link may not be used in connection with or appear on a website that a reasonable person might consider offensive, obscene, defamatory, or otherwise malicious.
  • We reserve the right to revoke consent to the link at any time in our sole discretion. If ACP revokes such consent, you agree to immediately remove and disable any and all of your hyperlinks to the Site.

NEITHER ACP, NOR ITS RELATED COMPANIES, NOR ITS AFFILIATES, NOR ITS SUPPLIERS MAKE ANY WARRANTIES REGARDING THE INFORMATION, EITHER EXPRESS OR IMPLIED, AND ACP, ITS RELATED COMPANIES AND AFFILIATES, AND ITS SUPPLIERS EXPRESSLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR THAT THE INFORMATION WILL BE NON-INFRINGING, RELIABLE, CURRENT, COMPLETE, ACCURATE, OR MEET YOUR REQUIREMENTS, OR THAT ANY MEDICAL TREATMENT OR HEALTH CARE THAT YOU RECEIVE FROM YOUR HEALTH CARE PROVIDER WILL BE EFFECTIVE, APPROPRIATE, SATISFACTORY, OR COMPETENTLY RENDERED. YOUR SOLE REMEDY FOR ANY CLAIM OF BREACH OF CONTRACT OR ANY DUTY THAT ACP OR ITS SUPPLIERS MIGHT HAVE TO YOU, IS TO DISCONTINUE YOUR USE OF THE INFORMATION AND THIS SITE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify and hold A Couples Place Inc., its employees, its related companies, and its affiliates harmless from any claim or demand, including attorneys' fees, arising out of your use of the Sites and/or the Services or your violation of our Terms and Conditions of Use, or the infringement by you of any intellectual property or other right of any person or entity.

Injunctive Relief

Because of the unique nature of the Information, you understand and agree that ACP, its related companies and affiliates, and its suppliers will suffer irreparable injury in the event you fail to comply with any of the Terms of Use and that monetary damages may be inadequate to compensate Licensor for such breach. Accordingly, you agree that ACP will, in addition to any other remedies available to it at law or in equity, be entitled to injunctive relief, without posting a bond, to enforce the Terms of Use.

Termination

ACP may immediately terminate your right to use this Site and the Information if you breach any representation, covenant, agreement, or obligation contained or referred to in the Terms of Use.

Miscellaneous

You may not assign or transfer your rights under the Terms of Use without the prior written consent of ACP. Any such attempted transfer or assignment in contravention of this provision shall be null and void. You acknowledge that you have read the Terms of Use, understand it and agree to be bound by its terms and conditions. You also agree that the Terms of Use is the complete and exclusive statement of the agreement between aCouplesPlace.com and you and supersedes all proposals, representations or prior agreements, oral or written, and any other communications between aCouplesPlace.com, its related companies, and its affiliates and you relating to the subject matter of the Terms of Use. The Terms of Use may not be amended, except by an agreement in writing which is signed by you and an authorized representative of aCouplesPlace.com. Waiver of a breach of or right hereunder will not constitute a waiver of any other or subsequent breach or right. If any provision herein shall be held by a court of competent jurisdiction to be contrary to law, that provision shall be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law, and the remaining provisions herein will remain in full force and effect.

Governing Law and General Provisions

The Terms and Conditions of Use will be governed by the laws of the State of North Carolina, U.S.A., excluding the application of its conflicts of law rules. The Terms and Conditions of Use will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. Venue for any action under the Terms and Conditions of Use shall be in state or federal courts in Wake County, North Carolina. You consent to the personal jurisdiction of the courts of such venue. If any part of the Terms and Conditions of Use is found void and unenforceable, it will not affect the validity of the balance of the Terms of Use, which shall remain valid and enforceable according to its terms.
